NEW RULES FOR SWEDISH LABOUR IMMIGRATION
The Swedish government introduced new rules for labour immigration to Sweden in December 2008. These new rules make it easier for people to come to Sweden to work and for Swedish companies to recruit labour from outside the European Union.
Any Swedish employer who cannot meet the labour needs of the company within the European Union, is from the 15th of December 2008, able to recruit labour from a third country if certain conditions are fulfilled. It is now easier to come to Sweden for a job interview, and the permits provided will be longer. When processing cases regarding residence and work permits, decisions will be based upon the employer’s needs.
The terms offered, like salary and insurance protection, should be in accordance with the so-called collective agreements that are used in Sweden. This is to ensure that the employer is paying market salary and that the working hours are in accordance with Swedish law. This task will be maintained by the Swedish Migration Board, which means all cases including residence and work permits will be dealt with by the same agency.
The time limits for work permits will now be extended. A temporary permit can be granted for maximum 2 years. If the person is still working after 2 years, the permit can be prolonged one or several times, up to a total of maximum 4 years. Then a permanent permit can be granted, without leaving Sweden in the mean time. If the job for some reason ceases to exist, the employee has a transit period of three months to find a new position in Sweden, otherwise the persons' permit will be revoked.
It is now easier for foreign individuals to get visas for job interviews. If a person is offered employment, it may not be necessary to go back home to apply for a work permit. This is also the case for students of higher education who study in Sweden. After finishing at least one semester of full time studies, students can apply for work permits without having to leave Sweden.
